Please read these Terms of Service ("Terms") carefully before using Callporch ("Service") operated by Callporch ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the Service.

1. Description of service

Callporch provides a lead capture chat widget platform that allows businesses and agencies to install a chat widget on their websites to collect visitor information and generate leads. The Service includes a dashboard for managing sites, viewing conversations, and configuring widget settings.

2. Accounts and registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • You must be at least 18 years old to use the Service.
  • One person or legal entity may not maintain more than one free account.
  • You must notify us immediately of any unauthorized use of your account.

3. Subscriptions and billing

Free trial

We offer a 14-day free trial for new subscribers. A valid payment method is required to start a trial. You will not be charged until the trial period ends. You may cancel at any time before the trial ends to avoid being charged.

Subscription plans

Paid subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time through your billing dashboard or by contacting support. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

Refund policy

We offer a 14-day money-back guarantee from the date of your first charge (after the free trial). To request a refund, contact support@callporch.com within 14 days of your first charge.

Price changes

We reserve the right to change subscription prices. We will provide at least 30 days notice before any price change takes effect. Continued use of the Service after a price change constitutes acceptance of the new price.

4. Acceptable use

You agree not to use Callporch to:

  • Collect personal information without proper consent from visitors
  • Violate any applicable laws or regulations
  • Send spam or unsolicited communications
  • Install the widget on websites you do not own or have permission to modify
  • Attempt to circumvent rate limits or security measures
  • Resell or sublicense access to the Service without our written permission
  • Use the Service for any illegal or fraudulent purpose
  • Interfere with or disrupt the integrity of the Service
  • Collect sensitive personal information such as financial account numbers, government IDs, or health information through the widget

5. Your responsibilities

As a Callporch customer, you are responsible for:

  • Maintaining a legally compliant privacy policy on any website where you install the Callporch widget
  • Obtaining any required consents from website visitors before collecting their personal information
  • Complying with all applicable data protection laws including GDPR, CCPA, and other relevant regulations in your jurisdiction
  • The security and appropriate use of any lead data you collect through the Service
  • Ensuring the widget is only installed on websites you are authorized to modify

6. Data and privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

With respect to visitor lead data collected through your widgets, you are the data controller and Callporch acts as a data processor on your behalf. You are responsible for ensuring you have a lawful basis for collecting and processing this data.

7. Intellectual property

The Service, including its software, design, and content, is owned by Callporch and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

You retain ownership of any content you provide to the Service, including your site configurations and lead data. You grant us a limited license to use this content solely to provide the Service.

8. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime. We are not liable for any losses resulting from service interruptions.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

9. Limitation of liability

To the maximum extent permitted by law, Callporch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the Service.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that any defects will be corrected.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by canceling your subscription and contacting support to request account deletion.

12. Governing law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or prominent notice on the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
